In January 2019, James Cerisier was pulled over for an illegal lane change. Officer Saurabh Shah point his loaded firearm and signaled for Cerisier to pull over. Cerisier did so, and despite the fact that he was completely compliant with Officer Shah's demands, Shah continued to point the loaded gun at Cerisier. Eventually, Shah let Cerisier off with a warning.
When Cerisier attempted to sue for this blatant violation of his rights, the United States District Court for the Eastern District of New York granted Shah qualified immunity. Now, on appeal, IJ has submitted an amicus brief, urging the 2nd U.S. Circuit Court of Appeals to overturn the lower court's ruling granting Shah qualified immunity.
